Divorce:

Dissolution of marriage (divorce) is a traumatic event in any family. Florida has "no fault" divorce to the extent that you no longer need to prove adultery, mental cruelty, etc. As long as one spouse believes that the marriage is irretrievably broken (i.e., that it cannot be saved), the court will grant the divorce. However, if you have children and believe there is a possibility for reconciliation, the court may order both of you to attend counseling and will order you to attend a course entitled "Divorce: A Child's View".

Alimony:

The consideration for and award of alimony is covered by Section 61.08 of the Florida Statutes. In a proceeding for dissolution of marriage, the court may grant alimony to either party. The alimony may be rehabilitative or permanent in nature. In any award of alimony, the court may order periodic payments or payments in lump sum or both. The factors that determine whether the court will award one of the party’s alimony are different in each case and can be extremely complicated.

Child Support:

Parents of minor children have an equal responsibility for the continued support of the children in accordance with their needs and your financial abilities. Support may be by direct payment or by indirect benefits, such as mortgage payments, insurance, or medical and dental expenses. Ordinarily, the obligation to support your child ends when that child reaches 18, marries, or becomes financially independent.

Timesharing:

It is the public policy of Florida to ensure each minor child has frequent and continuing contact with both parents after the parents have separated or divorced, and to encourage parents to share the rights and responsibilities of child rearing. The father is given the same consideration as the mother in determining an appropriate timesharing arrangement regardless of their child's age, sex, or other factors. In most cases, parental responsibility for a minor child will be shared by both parents so that each retains full parental rights and responsibilities with respect to their child. This requires both parents to confer so that major decisions affecting the welfare of the child will be determined jointly.

Collaborative Law:

Collaborative Law is a relatively new concept in divorce which we completely support. Collaborative Law is a contract between you, your spouse, your lawyer and your spouse's lawyer. That contract provides for the four participants in the divorce to strive at all times to achieve a settlement of all issues. The parties must provide complete disclosure to each other through their attorneys in order to permit a full understanding of the issues and finances which will lead to settlement. In order to vest the parties and their counsel in the settlement process, Collaborative Law contracts require that both lawyers are discharged and new lawyers must be retained, should either party proceed to Court on any issue. We believe that Collaborative Law is "divorce of the future" and will better serve the needs of many of our clients. However, we also believe it is not meant for everyone.
